MobiTV Trying to Shut Down Howard Forums

MobiTV Inc., provider of Sprint Nextel cell phone TV service is trying to shut down Howard Forums because the forum has instructions on how to access MobiTV channels for free. Howard Forums is a very popular forum about cell phones and cell phone carriers. Sprint currently charges $9.99 per month for access to 100 MobiTV channels.

MobiTV initially sent a letter to Howard Forums to remove the links, however, the owner of the site, Howard Chui, refuses to remove the links stating they are just links.  MobiTV then sent a letter to the site's Web host, Atlanta-based Global Net Access LLC, asking them to shut down Howard Forums.  It seems the Web Host isn't complying with the request because the site is still up.

Chui claims he has complied with past cease-and-desist letters from copyright owners when users posted pirated software. However, in this situation, he believes simply posting links to MobiTV's Web site is fine because it's accessible to anyone on the Internet.
